The International Court of Justice has called on Israel to stop genocidal acts amid the war in Gaza. However it stopped short of calling for a ceasefire in the ongoing case filed by South Africa.

“At least some of the acts and omissions committed by Israel in Gaza appear capable of falling within the provisions of the Genocide Convention. In the light of the following, the Court concludes that it has prima facie jurisdiction to consider the case on the basis of Article 9 of the Genocide Convention… The Court cannot accept Israel’s request not to consider the application, ” said Judge Joan E. Donoghue.

Although the ICJ’s ruling is legally binding, it is difficult to enforce. Legal experts also said that a final decision on whether Israel is committing genocide against Palestinians could take years.

Some highlights of the decision are as follows:

  • Donoghue said, “At least some of the acts and omissions committed by South Africa against Israel in Gaza appear capable of falling within the provisions of the (genocide) convention.”
  • The court said South Africa stood its case and ruled in favor of its request for provisional measures against Israel. It said the court “cannot accept Israel’s request not to consider the application”.
  • Judges in The Hague determined that Palestinians were a protected group under the Genocide Convention. It said that ‘at least some of the rights claimed by South Africa and for which it is seeking protection are laudable’ and highlighted the right of Palestinians in Gaza to be protected from genocide.’
  • Israel has been ordered to take steps to ensure that its forces do not engage in acts of genocide and to prosecute those who incite such behavior. The ICJ also demanded Israel take steps to punish public requests for genocide.
  • The ICJ also asked Israel to allow humanitarian aid into Gaza.
  • The Benjamin Netanyahu-led nation has been asked to report to the ICJ within a month. The UN body also demanded that the country preserve evidence of actions that violate the Genocide Convention.
