Mahua Moitra defamation case: Delhi High Court re-notifies the case for December 11 – Gudstory

Delhi High Court will now hear the defamation case filed by TMC MP Mahua Moitra on December 11. The case was filed as the politician was battling allegations that she received cash and other gifts for asking questions in the Lok Sabha. However, Moitra had informed the court in November that she was not pressing for any relief in the litigation against the media houses and social media intermediaries. His lawyer – Samudra Sarangi – was asked to file an amended memorandum of parties along with the amended suit.

A bench of Justice Sachin Dutta on Tuesday said that the formal application under 6(17) CPC was not filed with the amended suit. Justice Dutta re-notified the matter for December 11, asking the lawyers appearing for the TMC leader to file relevant applications following due procedure to amend the suit.

Moitra is currently facing expulsion from the lower house of Parliament after the Ethics Committee report criticized her “highly objectionable, unethical, heinous and criminal conduct”. The committee has reportedly recommended Moitra’s removal in the “cash-for-query” case. However, the exact details remain unclear as the bill has not yet been introduced.

“What can I say when it was not even presented (before Parliament)? If he had presented it, I would have said something. When they present it I will say…let’s see. This work was not in the list. I don’t know if they’ll keep it or not. If they do, let them do it,” Moitra told reporters before entering Parliament on the second day of the winter session.

Earlier this year, BJP MP Nishikant Dubey had written a letter to Lok Sabha Speaker Om Birla accusing Moitra of asking questions in the Lok Sabha. He argued that the questions were asked to target the Adani Group on the orders of businessman Darshan Hiranandani in exchange for gifts.

The Lok Sabha Ethics Committee had submitted its draft report related to the ‘cash-for-query’ issue to the Speaker last month.
