Judge vs Judge: SC takes suo motu cognizance of Calcutta HC order, hearing on Saturday – Gudstory

The Supreme Court has taken cognizance of the ongoing dispute between the Calcutta High Court and the Division Court regarding the fake caste certificate case in West Bengal.

After taking suo motu cognizance of the case, a five-judge bench led by Chief Justice DY Chandrachud will hear the case on Saturday.

The other four members of the bench will be Justice Sanjiv Khanna, BR Gavai, Surya Kant and Aniruddha Bose.

The case titled “In Re: Orders of the Calcutta High Court dated 24.01.2024 and 25.01.2024 and ancillary issues,” arose out of certain orders passed by the Single Judge Bench and Division Bench of the Calcutta High Court in disagreement with each other.

In the High Court order, Justice Abhijit Gangopadhyay has accused Justice Soumen Sen, who is leading the Division Bench, of working for a political party in West Bengal.

The controversy erupted when a single judge bench of Justice Abhijit Gangopadhyay set aside the HC division bench’s order and directed the CBI to initiate its own investigation in the fake caste certificate case.

Justice Abhijit Gangopadhyay said that Justice Sen is clearly working for some political party in the state of West Bengal and hence, if the Supreme Court thinks so then there is a need to re-look at the orders passed by the bench led by Justice Sen. .

Justice Abhijit Gangopadhyay said Justice Sen’s actions were aimed at protecting some political party in power and amounted to clear misconduct, ANI reported.

Fake certificate scam in Bengal

The matter came to light after a petition was filed in the HC alleging issuance of fake caste certificates to employees to ease admission to medical courses.

On January 24, a single judge bench of Justice Gangopadhyay had asked the West Bengal Police to hand over documents related to the case to the CBI. However, the single judge’s order was stayed after it was mentioned before the division bench of Justices Sen and Uday Kumar.

The case again went to a single judge bench of Justice Gangopadhyay and asked the state police to hand over the papers to the CBI. However, the division bench did not approve the order on Thursday. Finally, a single-judge bench passed observations against the judge on January 25.
