File returns by due date: MCA tells companies – Gudstory

New Delhi: The Corporate Affairs Ministry has asked businesses to file their annual returns and financial statements for FY2013 by the due date to avoid paying additional penalties.

The ministry, in an advisory posted on its website, said companies will have to adhere to their due date which depends on the date of their annual general meeting as per the Companies Act.

Businesses have six months after the end of the financial year to hold an annual general meeting, one month to file financial statements from the AGM and 60 days to file the annual return from the AGM.

Additional penalty is imposed on delay Rs 100 every day.

Thus, financial statements have to be filed by the end of October and annual returns by the end of November. This year approximately 15 lakh active companies have to file these statutory documents.

The ministry’s message comes after the government asked companies to file their annual reports and financial statements using the older version of the form (known as version two) instead of introducing the latest high security form just ahead of the filing season. It has been decided to allow it.

The objective was to avoid any disruption in the filing of these important statutory documents. More than 50 other statutory filing requirements have already been transferred to the new higher security forms. In those cases, the Ministry had also given relief in terms of additional time for filing documents without additional fee.

The annual return and financial statement forms will be migrated to the new version with two-factor authentication after the current filing season, a government official said on condition of anonymity.
