The Ministry of External Affairs on Thursday issued an advisory cautioning people against “fake foreign jobs and illegal recruitment”. This advisory was issued for job seekers abroad.

In its advisory, the Ministry of External Affairs noted that “there has been a sharp increase in the number of foreign job seekers who are being defrauded through fake job offers by unregistered recruitment agents as well as overcharging going.” 2-5 lakhs”.

How to spot fake job offers from abroad?

The ministry noted that “many illegal agents operate through Facebook, WhatsApp, text messages and other such mediums”. “These agencies provide little or no details about their locations and contacts,” it said.

“They generally communicate only through WhatsApp, making it difficult to trace the location and identity of the caller and the genuineness of the job offer,” the ministry said. Such agents make workers difficult and life-threatening. They also tempt people to work under the circumstances.”

It said such cases of fake job offers for recruitment for work are being reported in many Eastern European countries, some Gulf countries, Central Asian countries, Israel, Canada, Myanmar and Lao People’s Democratic Republic.

How to avoid becoming a victim of fake job offers?

The Ministry of External Affairs said that a valid job offer comes with an employment contract duly signed by the foreign employer, the recruitment agent and the migrant worker.

It says, “The employment contract must specify the conditions of employment to be offered and the salary and other emoluments.”

The ministry further said that employees with valid job offers should be allowed to migrate on the basis of employment or work visa or other similar visas, except tourist visas.

“It should be noted that tourist visas should be used only for tourism purposes. Generally, reputable foreign employers provide the cost of airfare, boarding and lodging and insurance cover,” the ministry said.

As per the advice, migrant workers should make themselves aware of the local conditions of the destination country. “Information can be obtained by attending Pre-Departure Orientation Training (PDOT) centers or from the Community Welfare Wing of the concerned Indian Embassy in the destination country,” the ministry said.

The Government of India has made it mandatory for registered recruitment agents to purchase the Pravasi Bharatiya Insurance Scheme (PBBY) for migrant workers, which includes various benefits. Sum Assured of Rs 10 lakh with lump sum premium on cases of death and work related injury and medical expenses ( 275 more for two years cover 375 for three years cover).

The Ministry of External Affairs also requested people to “use only the safe and legal services of Registered Recruitment Agents (RAs)”.

“All registered RAs are issued a license number, which is prominently displayed in their office premises and in their advertisements including newspapers and social media,” the ministry said.

The ministry advised “potential emigrants” to check the genuineness of the recruiting agents by visiting the government website www.emigrate.gov.in and clicking on the link “List of Active RAs”.

“As per the Emigration Act 1983, no recruitment agent shall charge a prospective migrant a service fee exceeding Rs.30,000 + GST ​​(18%), in respect of the services provided by him to that migrant and the recruitment agent shall issue a receipt to the migrant for the amount collected by him in this regard,” the ministry said.

It warns that “going abroad through any other means of recruitment carries a serious risk of being defrauded out of money, not getting the job promised, and difficult living conditions abroad”.

The Ministry of External Affairs said, “All unregistered agencies are being warned not to engage in foreign recruitment activities. Such activities are in violation of the Emigration Act 1983 and amount to human trafficking, which is a punishable criminal offence.”
